Judges Uphold iTunes UK Domain Decision

Big Business Vs Little Business, big business wins!...

August 06, 2005 by Andy Day
An iTunes cyber squatter has suffered a bit of legal slapping after the High Court told him he can’t have his iTunes domain name back.

Benjamin Cohen bought the domain iTunes.co.uk in 2000 but instead of using it for something useful like say a website, he has instead apparently been offering to sell it to Apple and has used it to direct web users to other sites.

In March internet registration gods for the UK, Nominet took the domain from him and gave it to Apple, who have since used it to direct customers to their iTunes website. But Cohen has argued that Nominet are biased against small businesses and applied to the men in wigs and tights for a judical review.

Unperturbed by the High Court decision Cohen is considering whether to continue his legal fight against Nominet with an oral hearing. Meanwhile Nominet plan to whoop him again for legal costs.
