Over a cancelled show...

My Chemical Romance Face Lawsuit From US University
Share

My Chemical Romance could be facing legal proceedings from an American university over a cancelled show last weekend.

The band were due to play the University of Maine last Saturday (October 27), but pulled out at the eleventh hour blaming an apparent “medical issue” within in the band.

Now the Student Government at the campus have sent two letters to the band asking for $20,500 to cover “lost” costs, covering money paid out for advertising, money paid to contractors and compensation costs.

They’ve given the band and their management until November 12 to stump up the cash, otherwise they will take a vote over whether to launch a lawsuit. This is all despite My Chemical Romance saying they will honour the show at another time - an offer that the university turned down.

Speaking to the university’s magazine, Maine Campus, Derek Mitchell, the vice president of student entertainment, said: "Unless it is truly due to sickness or injury of the band, we intend to seek full damages for breach of contract. When they played Friday night, I think that kind of voids an 'Act of God' claim.

“Come Monday, if we haven't received a check or have no word from them that they intend to pay, we can go to senate on Tuesday night and discuss it further."

Clearly irate at the cancellation, Mitchell continued: "Essentially this loss of $20,000 is a loss of their constituents money. It is really their obligation to allow us to legally recover that in any way possible. I'm going to fight this to the death. Students will get their money back. It will come back to student entertainment, and we will have big concerts.”

Those who have paid by credit card for the gig have been immediately refunded. However cash payees may have to wait up to six weeks to get their money back.

    • MCR is pretty much my life. So if one of them has a freaking MEDiCAL PROBLEM, then they have the right to cancel a show. They even offered to do another show at a different time, but whoever is doing this just had to be a biotch and try to SUE them! And all the people could so get their money back easily. So leave my chem alone.

  • ”I’m going to fight this to the death.” - Bit full-on there. I find this really stupid, My Chem said they’d honour the gig which is very admirable. Mr. Mitchell should really calm down. It’s not like My Chem are being rude or ignorant.. they should just negotiate something between them ie. the University and the band, no need for all this bother. And seriously, stop the bashing. What are you, like nine?

  • They agreed to do another show at a later date. The University turned it down. How stupid is that.Yeah they played the Friday show, but there was definetly something wrong and they ended the set about 15 minutes early.I know because i was there and was disappointed until i heard it was due to injury/illness.They are only human and i think the university is wrong to have turned them down for rescheduling a show.If i was part of MCR i would never do a show for this university, not after all this!

  • ^^ Exactly, I don’t know what the Vice President of the University is making such a big deal about. The band said they’d play the show at a later date. And as far as I know, the drummer broke his wrist during a video shoot. They probably didn’t have the time to find a replacement.

  • I’m a fan of MCR, but in this case, I back up the university. They are not show promoters, they are students. They must’ve devoted themselves preparing the show. Now, they had to cancel all the stuff like stage set, security, food, so on... They didn’t ask millions of dollars for the compensation. Just a tiny expense for MCR management.

They said they’d happily do a show another time, so why are people taking legal actions agaiinst them? Acts cancel shows all the time. Personally, I think this is very uncalled for, especially as a band member is currently suffering an injury.

MCR should def pay back some of the money. it will all come down to what the contract says and circumstances in which why MCR had to cancel.

  • A few points 1) MCR canceled the Saturday show Thursday night ”due to a medical situation” AFTER opening for Bon Jovi,2)then played FRIDAY night in NJ; & 3) as they have not yet rescheduled the May concert (which was canceled for a very valid reason), the University is understandably gun shy about expending any more funds to promote a show for them. If in fact Bob was injured, perhaps if their management had told the University this, there would be less anger. (BTW, I am a fan)

The band canceled the Oct. 27 show at UMaine a few days before the date due to medical issues, but played their dates before and after the UMaine date, which led the SG to feel the ”Act of God” clause was breached. Alfond Arena (venue loc) takes months of pre-scheduling, as it also hosts multiple sports teams. UMaine turned down the reschedule because of construction on their own concert
